4C. When Treatment Can Be Provided Without Consent

You can withdraw your consent for treatment at any time. The best way to make sure treatment stops is to follow up with a written withdrawal of your consent.

Note: the facility may treat the ward without consent in some emergency situations. In these situations, both the ward and the guardian
should get a statement that explains the ward’s rights. The right to talk to an attorney is one of those rights. You will also receive a statement explaining that a medical professional will examine the patient within 24 hours.

You’ll need to know a couple of terms for emergencies:

  • Right to treat: A facility does not need your permission to provide emergency medical care which is immediately necessary.
  • Detention or hospitalization: Sometimes patients hurt themselves or other people. If that’s about to happen, health care providers can do what’s necessary to stop it.
